Michelle is an employment and business lawyer, defending employers in actions involving harassment, discrimination, retaliation, wrongful termination, wage and hour violations and business torts. Michelle is a highly skilled trial attorney and regularly appears before various state and federal governmental agencies. Michelle’s experience includes jury and bench trials, arbitrations, appellate arguments in both state and federal court and the defense of wage and hour class action lawsuits.

In addition to her litigation practice, Michelle regularly advises clients on employment law issues in the workplace, including the proper handling of termination and discipline decisions, workplace accommodation issues, and leaves of absence. Michelle provides her clients with all the advice and litigation expertise they need to stay current and compliant in the ever changing landscape of employment laws and regulations, while recognizing the balance of business realities and economics.

Michelle’s practice includes representation of clients throughout the state. In February 2016, she joined the firm of Nemecek & Cole as an Of Counsel attorney. Nemecek & Cole is recognized as a preeminent business litigation Southern California law firm. Originally from Southern California, Michelle moved to Danville in 1997. Since that time, she has become involved in both the legal and local community. Michelle is a past officer of the Contra Costa County Bar Association and also served on the Executive Committee of the Board of Directors. She was recently recognized as the 2015 “Board Member Extraordinaire.” She is a past President of the Contra Costa County Bar Association Employment Section and former Secretary of the Contra Costa County Bar Associations’ Women’s Section. She is a former President of Beth Chaim Congregation, and was an integral part of the process of building its first permanent home in Danville. Michelle also served at Dougherty Valley High School as its founding attorney mock trial coach and as founding member of its Athletic Boosters Association.

Michelle currently serves as a volunteer for Contra Costa County Superior Court as a Discovery Facilitator. She is a graduate of the Contra Costa County Leadership Program and is an active member of various chambers of commerce and ProVisors.


Michelle is a 1987 graduate of California State University, Northridge, where she majored in Journalism and wrote for the college newspaper. She received her J.D. in 1990 from Southwestern University School of Law, receiving various awards for excellence in academics and writing. Mr. Babione concentrates his practice on employment, business and other civil litigation in state and federal courts. He practices in a broad range of employment matters, including discrimination, harassment, wrongful termination, and wage and hour claims. Other areas of practice include complex tort litigation, construction defect, and personal injury defense.

For seven of those years, she also acted as corporate general counsel for homeowners’ associations (small non-profit corporations). In addition to practicing employment law, she has significant experience in corporate law, insurance, surety, construction, real estate, probate, trusts, and public entity work.

Professional & Community Activities

Ms. Lucas is a member of the Contra Costa County Bar Association. She is also the chair of the Run Club at Golden View Elementary School, where the eldest of her three young sons is a student. In her precious few moments of free time, she enjoys reading and swimming.


Ms. Lucas graduated from The Ohio State University in 1998 with degrees in English and Theater. She received her J.D. in 2003 from the University of San Francisco School of Law, where she participated in USF’s law review, and was a moot court semi-finalist.

Stephen brings twenty years of experience counseling clients in business litigation and business transactions in multiple industries, but with a particular emphasis on the technology and construction industries. Stephen also counsels clients on general business matters and provides dispute resolution services as a mediator.

Business Litigation

Stephen specializes in breach of contract actions, unfair competition, trade secret misappropriation, mechanics lien and payment bond remedies and other forms of commercial disputes. For example, Stephen regularly handles cases involving trade secret misappropriation and non-competition agreements in state and federal courts in California and New York.

Construction Contracting and Construction Claims

Stephen counsels licensed contractors and helps them to successfully conduct business in California by drafting and negotiating construction contracts, advising on licensure issues and managing litigation involving mechanics lien remedies, bid disputes and construction and design defects. For example, Stephen acted as lead trial counsel in a trial involving the intentional misappropriation of trade secret information contained in construction bids, where he won a judgment in favor of his client for general damages, punitive damages and an award of attorney’s fees.

Intellectual Property Licensing and Distribution

Stephen regularly counsels clients on licensing and distribution of intellectual property, including trade secrets, copyrights, trademarks, and patents. He also provides general guidance and counseling on intellectual property issues, including ownership, licensing and distribution issues, and privacy and data security involving websites. For example, Stephen recently drafted the website terms of use and privacy policies for several film and television studios.

General Business Matters

Stephen also represents entrepreneurs, businesses, and investors with business formation, acquisitions, commercial transactions and business dissolution.  For example, Stephen recently assisted with the formation of a new Irish pub in Jack London Square, where he assisted the owners in forming a business entity, drafting the founders’ agreements, negotiating a lease with the building owner and obtaining a liquor license.

Dispute Resolution

Stephen received a Mediation Certificate from the Strauss Institute for Dispute Resolution at Pepperdine University College of Law in 2012. He is a member of the mediation panels in both Alameda County Superior Court and Contra Costa County Superior Court. Stephen regularly mediates cases involving the same business and legal issues familiar to his own law practice.


Stephen received a B.A. in International Studies from the University of Washington in 1994. He graduated from Syracuse University College of Law in 1997 with a Juris Doctor and a Certificate in International Law.

With almost 30 years of experience representing employers in labor and employment matters, Ms. Giammona is a passionate and loyal advocate for business owners. Ms. Giammona defends employers against wrongful termination, harassment, discrimination and wage and hour issues in state and federal courts, at administrative hearings, and at arbitrations and mediations. Her analytic and strategic mind allows Ms. Giammona to immediately spot issues and build a comprehensive plan to affect resolution. In addition to defending litigation cases on behalf of employers, Ms. Giammona also provides advice and counsel to employers regarding leaves of absence, compliance with wage and hour issues, discipline and termination process, drug testing, and workplace violence issues. Because of her compassion and personal investment in her client’s experience, Ms. Giammona quickly establishes trust with clients. Ms. Giammona believes treating others with dignity, respect, honesty, and integrity is the key to a lasting relationship.

Joining Ferber Law as Of Counsel, Ms. Giammona brings with her years of experience from one of the largest multi-national, global law firms that exclusively represents employers. After leaving the “big firm” atmosphere, Ms. Giammona opened her own office, continuing in her representation of employers. Ms. Giammona recently relocated back to the East Bay, her childhood home. Ms. Giammona is a member of the Contra Costa County Bar Association, Employment Law Section. She is actively involved in health advocacy in her community, often assisting others in obtaining access to critical health care and medication. Education is another love of Ms. Giammona, and she has spent countless hours assisting families in home schooling their children due to medical illness or crisis. Ms. Giammona and Valentino Raffaele, her 7-year-old rescue Schnoodle, are a certified Reading Education Assistance Dog Team.


Ms. Giammona graduated from California State University, Northridge, Summa cum Laude, in 1984, with a major in Sociology. She received her J.D. from Loyola Law School, Order of the Coif, in 1990.
