Michelle is an employment and business lawyer, defending employers in actions involving harassment, discrimination, retaliation, wrongful termination, wage and hour violations and business torts. Michelle is a highly skilled trial attorney and regularly appears before various state and federal governmental agencies. Michelle’s experience includes jury and bench trials, arbitrations, appellate arguments in both state and federal court and the defense of wage and hour class action lawsuits.

In addition to her litigation practice, Michelle regularly advises clients on employment law issues in the workplace, including the proper handling of termination and discipline decisions, workplace accommodation issues, and leaves of absence. Michelle provides her clients with all the advice and litigation expertise they need to stay current and compliant in the ever changing landscape of employment laws and regulations, while recognizing the balance of business realities and economics.

Michelle’s practice includes representation of clients throughout the state. In February 2016, she joined the firm of Nemecek & Cole as an Of Counsel attorney. Nemecek & Cole is recognized as a preeminent business litigation Southern California law firm. This relationship allows Michelle the flexibility to effectively represent her clients, regardless of geographic location.

Michelle’s client base includes retailers, restaurants, medical and dental providers, trucking and moving companies, contractors, architects, attorneys, and non-profit organizations.

Professional & Community Activities

Originally from Southern California, Michelle moved to Danville in 1997. Since that time, she has become involved in both the legal and local community. Michelle currently serves as an officer and on the Executive Committee of the Board of Directors of the Contra Costa County Bar Association. She was recently recognized as the 2015 “Board Member Extraordinaire.” She is a past President of the Contra Costa County Bar Association Employment Section and former Secretary of the Contra Costa County Bar Associations’ Women’s Section. She is a former President of Beth Chaim Congregation, and was an integral part of the process of building its first permanent home in Danville. Michelle also served at Dougherty Valley High School as its founding attorney mock trial coach and as founding member of its Athletic Boosters Association.

Michelle currently serves as a volunteer for Contra Costa County Superior Court as a Discovery Facilitator. She is a graduate of the Contra Costa County Leadership Program and is an active member of various chambers of commerce and ProVisors.

Michelle is a 1987 graduate of California State University, Northridge, where she majored in Journalism and wrote for the college newspaper. She received her J.D. in 1990 from Southwestern University School of Law, receiving various awards for excellence in academics and writing. In law school, Michelle served as an extern for the Honorable Arthur Alarcon of the Ninth Circuit Court of Appeals.

Mr. Babione concentrates his practice on employment, business and other civil litigation in state and federal courts. He practices in a broad range of employment matters, including discrimination, harassment, wrongful termination, and wage and hour claims. Other areas of practice include complex tort litigation, construction defect, and personal injury defense.

Mr. Babione is a member of the Contra Costa County Bar Association, including membership in the Barristers/Young Lawyers Section. He is also a member of the Robert G. McGrath American Inn of Court.

Education

Mr. Babione is a 2005 graduate of the University of California at Santa Barbara. He received his J.D. in 2009 from Golden Gate University School of Law.

Mr. Wickersham has been licensed as an attorney in the State of California since 1973 and has been admitted to practice before the United States Supreme Court since 1993. His practice emphasizes real estate and business-related matters as well as personal injury litigation. He has more than 40 years of trial and litigation experience.

Professional & Community Activities

Mr. Wickersham is a member of the Real Property Law Section of the California State Bar and is a member of the Contra Costa County Bar Association. Mr. Wickersham served on the arbitration panels of the Alameda and Contra Costa County Superior Courts between 1980 and 2000. In addition, he served as a court-appointed mediator in connection with civil litigation matters between 1995 and 2001. Mr. Wickersham has also served as a judge pro-tem for the Contra Costa County Superior Court. He is presently a member of the Fee Arbitration Panel of the Contra Costa County Bar Association and is on the panel of Discovery Facilitators for the Contra Costa County Superior Court.

Prior to admission to the California State Bar, Mr. Wickersham served more than 9 years as a police officer for the City of Oakland. He is a member of the One Hundred Club of Contra Costa County.

Mr. Wickersham graduated from California State University, Hayward, with a B.S. degree in accounting in 1968. He received his J.D. from San Francisco Law School in 1973.

Ms. Lucas has been litigating in both state and federal court for nearly fifteen years. For seven of those years, she also acted as corporate general counsel for homeowners’ associations (small non-profit corporations). In addition to practicing employment law, she has significant experience in corporate law, insurance, surety, construction, real estate, probate, trusts, and public entity work.

Ms. Lucas is a member of the Contra Costa County Bar Association. She is also the chair of the Run Club at Golden View Elementary School, where the eldest of her three young sons is a student. In her precious few moments of free time, she enjoys reading and swimming.

Education

Ms. Lucas graduated from The Ohio State University in 1998 with degrees in English and Theater. She received her J.D. in 2003 from the University of San Francisco School of Law, where she participated in USF’s law review, and was a moot court semi-finalist.

AREAS OF PRACTICE

Stephen brings twenty years of experience counseling clients in business litigation and business transactions in multiple industries, but with a particular emphasis on the technology and construction industries. Stephen also counsels clients on general business matters and provides dispute resolution services as a mediator.

Business Litigation

Stephen specializes in breach of contract actions, unfair competition, trade secret misappropriation, mechanics lien and payment bond remedies and other forms of commercial disputes. For example, Stephen regularly handles cases involving trade secret misappropriation and non-competition agreements in state and federal courts in California and New York.

Construction Contracting and Construction Claims

Stephen counsels licensed contractors and helps them to successfully conduct business in California by drafting and negotiating construction contracts, advising on licensure issues and managing litigation involving mechanics lien remedies, bid disputes and construction and design defects. For example, Stephen acted as lead trial counsel in a trial involving the intentional misappropriation of trade secret information contained in construction bids, where he won a judgment in favor of his client for general damages, punitive damages and an award of attorney’s fees.

Intellectual Property Licensing and Distribution

Stephen regularly counsels clients on licensing and distribution of intellectual property, including trade secrets, copyrights, trademarks, and patents. He also provides general guidance and counseling on intellectual property issues, including ownership, licensing and distribution issues, and privacy and data security involving websites. For example, Stephen recently drafted the website terms of use and privacy policies for several film and television studios.

General Business Matters

Stephen also represents entrepreneurs, businesses, and investors with business formation, acquisitions, commercial transactions and business dissolution.  For example, Stephen recently assisted with the formation of a new Irish pub in Jack London Square, where he assisted the owners in forming a business entity, drafting the founders’ agreements, negotiating a lease with the building owner and obtaining a liquor license.

Dispute Resolution

Stephen received a Mediation Certificate from the Strauss Institute for Dispute Resolution at Pepperdine University College of Law in 2012. He is a member of the mediation panels in both Alameda County Superior Court and Contra Costa County Superior Court. Stephen regularly mediates cases involving the same business and legal issues familiar to his own law practice.

EDUCATION

Stephen received a B.A. in International Studies from the University of Washington in 1994. He graduated from Syracuse University College of Law in 1997 with a Juris Doctor and a Certificate in International Law.
